This week the Court of Appeal handed down it’s judgement on Sleep-in’s at work and the National Minimum Wage.
They have now ruled that National Minimum Wage does not apply to sleep-in shifts and will only be paid if a worker is awake for the purpose of working.

It has also been ruled that no claims for back pay can be made. Many care providers feel that this is the right decision, a potential £400m in back dated pay has now been avoided, for the time being.
Although many care workers will not be pleased about this as many providers do not pay very high for sleeping night shift work; however here at Fountain Loving Care we are confident and pleased to say that we pay above average across our homes.
